The law, which takes effect August 1, shifts the burden of compliance and refund costs to kiosk operators, and is designed to address both regulatory gaps and rising fraud complaints tied to crypto ATMs.

Refund Rights and Operator Obligations

Under the new statute, users can cancel any transaction made on or after August 1 and request a full refund if the kiosk owner or operator did not hold a valid Louisiana virtual currency business license at the time. Operators must respond to refund requests within 10 business days, clearly outlining all requirements for processing the refund. The law also mandates that operators provide live customer support via a toll-free number during kiosk operating hours, with the number displayed on the machine and printed on transaction receipts.

Fraud Claims and Documentation

For refund requests based on suspected fraud, operators are permitted to require users to submit a police report or documentation of a complaint filed with a government agency, such as the FBI's Internet Crime Complaint Center. Proof of identification may also be required. If the operator's policy requires such documentation and the user provides it after the initial request, the 90-day refund deadline starts from the date the documents are submitted. Otherwise, refunds must be completed within 90 calendar days of the original request.

The refund right applies only to transactions where the operator was unlicensed at the time of the transaction; it does not cover all crypto ATM payments. Louisiana law already requires operators to hold transactions for 72 hours or allow users to cancel within that window for a full refund. As of July 31, the Louisiana Office of Financial Institutions listed 36 active virtual currency business licensees. The new law arrives amid a documented rise in crypto ATM-related fraud.
